Card autopay terms

This is a translation, provided so that you can read what you are agreeing to. The Polish version is the binding one and it is the version recorded when you switch autopay on.
In short
- We charge your card the amount on the invoice — the same one you see in the client panel before any money leaves your account. The amount varies, because it depends on the services used that month.
- The charge is taken once a month, no earlier than the invoice due date and no earlier than 7 days after the invoice was delivered to you.
- There is no trial or promotional period during which the card is not charged. The first charge is taken as soon as you switch the service on.
- You can withdraw consent at any time — one button in the client panel or an e-mail to biuro@naszkiewicz.com.pl. No fee, and no effect on your bookkeeping agreement.
§ 1. Who these terms are for and what they cover
- The service is provided by Michał Naszkiewicz Biuro Rachunkowe, NIP 7481590271, REGON 389854999, ul. Opolska 110, 31-323 Kraków, e-mail: biuro@naszkiewicz.com.pl, telephone: +48 453 225 505 (the „Office”).
- These terms govern automatic card payments (recurring charges to a payment card) for services the Office provides under a bookkeeping services agreement (the „Agreement”).
- Automatic payment is optional. Turning it down or switching it off changes neither the scope of the services nor the terms of the Agreement — invoices can be paid by bank transfer as before.
- „Client” means the party to the Agreement who switched automatic payment on. „Card” means the payment card the Client indicated when switching the service on.
§ 2. The payment operator and your card details
- Payments are handled by Autopay S.A., registered in Sopot, ul. Powstańców Warszawy 6, 81-718 Sopot, Poland, KRS 0000320590, NIP 5851351185, REGON 191781561 — a national payment institution supervised by the Polish Financial Supervision Authority (the „Operator”).
- The Office neither receives nor stores your card number or CVV/CVC code. You enter the card details directly on the Operator’s site. The Office receives only the consent identifier and the details that let you recognise your own card: the issuer, the last four digits and the expiry date.
- The Office sends the charge instruction to the Operator; the charge itself is made by the card issuer on the basis of the consent given by the Client under § 5.
- The bank issuing the Card may require additional confirmation (3-D Secure). If it does, the Office sends the Client a link to confirm the payment — until it is confirmed, no charge is taken.
§ 3. The amount charged
- The amount varies. This is not a fixed subscription fee — it depends on the services actually performed in the billing period.
- The amount charged is the gross amount of the VAT invoice issued to the Client for the billing period, made up of:
- the fixed part — the fee for the bookkeeping package in the amount stated in the Agreement;
- the variable part — the fee for additional services performed in that period, billed at the rates in the price list in force on the day the service was performed (in particular: payroll by headcount, documents above the package limit, one-off services) — where any such services occurred;
- reductions — discounts and corrections due to the Client, including rewards from the referral programme.
- The Client knows the amount before the charge. The invoice, with the amount and the due date, is delivered to the Client (client panel and e-mail) before the Card is charged, within the time limit in § 4(3).
- The charge is taken in PLN. If the Card account is held in another currency, the card issuer converts it at its own rate and on its own terms — the Office has no influence over this and charges nothing for it.
- Switching automatic payment on does not change prices. Fees change only in the way the Agreement provides for.
§ 4. How often and when the charge is taken
- The charge is taken once a month — one charge per invoice issued for a monthly billing period.
- The frequency can change in two cases, in both only at the Client’s request:
- with annual prepayment (11 months paid for 12 months of service) the charge is taken once a year, on the date shown on the annual invoice;
- where a one-off service is ordered and billed on a separate invoice, an additional charge may occur that month — on the terms in paragraph 3 and only up to the amount on that invoice.
- The date of the charge is set as follows: the charge is taken no earlier than the due date shown on the invoice and no earlier than 7 days after the invoice was delivered to the Client. The later of the two applies. If the day arrived at falls on a Saturday, a Sunday or a public holiday, the charge is taken on the next working day.
- If a charge fails (insufficient funds, a blocked or expired Card, a refusal by the issuer), the Office tells the Client by e-mail. The Office may retry no more than 2 times, at intervals of no less than 3 days. After the last failed attempt, the invoice is settled by bank transfer.
- Paying the invoice by transfer before the charge date means no charge is taken for that invoice.
§ 5. The Client’s consent and how long it lasts
- The Client switches automatic payment on themselves in the client panel, by accepting these terms and indicating a Card on the Operator’s site. The Office records the date, the time and the version number of the terms accepted (2026-09-14) — in case it ever has to show what was consented to, and when.
- There is no trial or promotional period during which the Card is not charged. The first charge is taken when the service is switched on and covers the amount due on the current invoice.
- Consent lasts indefinitely — for as long as the Agreement lasts, until it expires under paragraph 4. Consent creates no separate obligation and does not extend the Agreement; the Agreement remains one of indefinite duration with one month’s notice, as written.
- Consent expires:
- when the Client withdraws it (§ 8) — with immediate effect;
- when the Agreement is terminated or expires;
- when the Card expires;
- when the card issuer withdraws it or the Operator switches it off, in particular where the Client raised an objection with their bank or abuse is suspected.
- Consent expiring does not cancel amounts due. Invoices issued after that date are settled by transfer to the account shown on the invoice.
§ 6. Complaints and refunds
- Complaints about a card charge can be sent by e-mail to biuro@naszkiewicz.com.pl with „Płatność automatyczna” in the subject line. The Office answers within 14 days of receiving the complaint, to the Client’s e-mail address.
- A charge taken for more than the amount due, or with no basis at all, is refunded to the same Card without delay, and no later than 7 days after the overpayment is established or the complaint upheld.
- The Client’s rights against the card issuer, including the right to report an unauthorised transaction under the Polish Payment Services Act, are unaffected and apply regardless of any complaint made to the Office.
§ 7. Personal data
- The controller of the Client’s personal data is the Office. Data connected with automatic payment (the consent identifier, the issuer and the last four digits of the Card, the expiry date, the history of charges) is processed in order to perform the Agreement and settle payments — article 6(1)(b) GDPR — and to meet tax and accounting obligations — article 6(1)(c) GDPR.
- Data is disclosed, to the extent needed to make the payment, to the Operator (§ 2(1)), which acts as a separate controller in respect of handling payment transactions.

§ 8. How we communicate, and withdrawing consent
- The agreed means of communication about automatic payments are:
- the client panel — the state of the consent, the Card details, upcoming and completed charges;
- e-mail — the Office’s address: biuro@naszkiewicz.com.pl; the Client’s address: the one given in the Agreement or in the client panel.
- The Client may withdraw consent to recurring card charges at any time, without giving a reason and at no cost, in one of two ways:
- in the client panel — the „Wyłącz płatność automatyczną” (switch autopay off) button;
- by e-mail to biuro@naszkiewicz.com.pl — a message from the address given in the Agreement saying that consent is withdrawn is enough.
- Withdrawal takes immediate effect: the Office instructs the Operator to switch the consent off without delay, and no later than the next working day, and confirms this to the Client by e-mail. After withdrawal the Card is not charged.
- Withdrawing consent does not affect the Agreement or the obligation to pay amounts already due — those are settled by bank transfer.
- Consent can be switched back on at any time in the client panel, with the same Card or a different one.
§ 9. Changes to these terms
- The Office may change these terms for good reason: a change in the law, a change in how the Operator provides its services, security, or preventing abuse.
- The Office gives notice of a change by e-mail and in the client panel at least 14 days before it takes effect, saying what is changing.
- A Client who does not agree to a change may withdraw consent to recurring card charges before the day it takes effect — on the terms in § 8. Not withdrawing consent within that time means accepting the new wording.
- Charges taken before the day a change takes effect are governed by the old wording.
§ 10. Final provisions
- Matters not covered by these terms are governed by the Agreement, the Terms of service and Polish law, in particular the Payment Services Act and the Civil Code.
- Where these terms and the Agreement conflict, the Agreement prevails, except for the provisions on the card charging mechanism itself.
